Big Live CMS Platform Terms of Service

Last Updated: August 2026 · Master Subscription Agreement for Event Organisers, Promoters, and Administrative Clients.

These Terms of Service ("Agreement") govern access to and use of the Big Live Content Management System (CMS), Backstage platform, and developer APIs provided by Rhythm Labs Pty Ltd ("Big Live", "we", "our").

1. CMS Platform Access & Subscription License

Subject to compliance with this Agreement and payment of applicable event fees, Big Live grants the Event Organiser ("Customer") a non-exclusive, non-transferable, commercial license to access the Big Live CMS to configure, manage, publish, and monitor white-label or multi-tenant mobile event applications.

2. Account Security & Administrative Roles

Customer is responsible for maintaining the confidentiality of administrative credentials and for all activities conducted under its authorized user accounts (Admins, Editors, Safety Officers, and Vendors). Customer must notify Big Live immediately upon discovering any unauthorized account access.

3. Content Ownership & Intellectual Property

• Customer Content: Customer retains all right, title, and interest in and to all festival trademarks, artist schedules, sponsor assets, map files, and promotional materials uploaded to the CMS. Customer grants Big Live the right to host, sync, and deliver such content to end-user mobile apps.
• Platform IP: Rhythm Labs retains exclusive ownership of all intellectual property, source code, design systems, algorithms, APIs, and infrastructure powering the Big Live platform.

4. Compliance, Attendee Safety & Moderation Obligations

When utilizing interactive social features (including the Fan Wall and Community Chat):

• Customer agrees to abide by all applicable privacy laws and app store policies regarding user safety.
• Customer acknowledges that Big Live enforces a strict zero tolerance policy for objectionable content and abusive users.
• Customer administrators and Big Live moderators cooperate to review flagged content within 24 hours and immediately eject and ban users violating community standards.

5. Service Availability & Support SLA

Big Live strives to maintain 99.9% uptime for cloud synchronization and live event services during scheduled festival dates. Technical support and live event standby are provided in accordance with Customer's active service tier.

6. Fees and Invoicing

Event licensing fees, activation setup charges, and add-on module subscriptions are billed according to executed order forms or online subscription plans. Fees are non-refundable once an event is published and live in app stores.

7. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Big Live shall not be liable for any indirect, incidental, special, or consequential damages resulting from event cancellations, network interruptions at festival venues, or third-party telecom outages. Customer agrees to indemnify and hold harmless Big Live against third-party claims arising from Customer-provided content or event management activities.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of Australia, and parties submit to the exclusive jurisdiction of Australian courts.
